{"id":307,"date":"2017-04-06T08:41:42","date_gmt":"2017-04-06T08:41:42","guid":{"rendered":"http:\/\/www.classiciasacademy.com\/blog\/?p=307"},"modified":"2024-06-07T17:16:53","modified_gmt":"2024-06-07T11:46:53","slug":"sitting-judge-the-marriage-bill","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/sitting-judge-the-marriage-bill\/","title":{"rendered":"Contempt Of Court Against A Sitting Judge \/ The Marriage Bill"},"content":{"rendered":"<h3><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\"><b>Contempt Of Court Against A Sitting Judge:<\/b><\/span><\/span><\/span><\/h3>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><u><b>Actual<\/b><\/u><span style=\"color: #000000;\"><u><b> Issue<\/b><\/u><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Judge CS Karnan has on multiple occasions stated that he was a victim of caste bias as he was a Dalit and had accused the Madras HC chief justice of harassing him.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Subsequently when he was transferred, Karnan himself &#8220;stayed&#8221; the order of the SC, advising the CJI not to interfere in his &#8220;jurisdiction&#8221;<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">He later accepted his transfer.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">He also wrote to the PM, the law minister and the CJI, accusing several sitting and retired judges of corruption.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">This action had prompted the court to issue a\u00a0<\/span><span style=\"color: #000000;\"><b>contempt notice for alleged judicial indiscipline.<\/b><\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">This is the first time that a constitutional court has initiated contempt of court proceedings against a judge of the SC or HC.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The SC asked Karnan to appear before it in person for explanation. But the Judge chose not to appear before the SC.<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><u><b>Constitutional Provisions<\/b><\/u><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><b>Contempt of court &#8211; Article 129<\/b><\/span><span style=\"color: #000000;\">\u00a0and\u00a0<\/span><span style=\"color: #000000;\"><b>Article 215<\/b><\/span><span style=\"color: #000000;\">\u00a0empowers the Supreme Court and the High Courts respectively, to punish people for their contempt.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Article 129, states that \u201c<\/span><span style=\"color: #000000;\"><b>the Supreme Court shall be a court or record and shall have all the powers of such a court<\/b><\/span><span style=\"color: #000000;\"> including the power to punish for contempt of itself\u201d.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The power of contempt is often invoked\u00a0<\/span><span style=\"color: #000000;\"><b>to ensure compliance with the orders given by the courts<\/b><\/span><span style=\"color: #000000;\"> in their execution, and for punishing those who are responsible for the lapses in the manner of compliance.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Contempt jurisdiction is exercised<\/span><span style=\"color: #000000;\"><b>\u00a0to uphold the dignity of the judicial system<\/b><\/span><span style=\"color: #000000;\">\u00a0which includes within itself the dignity of courts and tribunals as well and\u00a0<\/span><span style=\"color: #000000;\"><b>to ensure the majesty of judicial institutions<\/b><\/span><span style=\"color: #000000;\">\u00a0so that it may not be lowered.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><b>Removal of Judge-<\/b><\/span><span style=\"color: #000000;\">\u00a0A judge of a high court can be removed in the same manner and on the same grounds as a judge of the Supreme Court as mentioned in Article 124 i.e by an order of the President. <\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The President can issue the removal order only after an address by the Parliament has been presented to him in the same session for such removal.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The address must be supported by a special majority of each House of Parliament i.e., a majority of the total membership of that House and majority of not less than two-thirds of the members of that House present and voting.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The grounds of removal are proved misbehavior or incapacity.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><b>Transfer of Judges \u2013<\/b><\/span><span style=\"color: #000000;\">\u00a0According to\u00a0<\/span><span style=\"color: #000000;\"><b>Article 222,\u00a0<\/b><\/span><span style=\"color: #000000;\">The President can transfer a judge from one high court to another after consulting the CJI.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The CJI should consult, in addition to the Collegium of four senior most judges of the Supreme Court, the chief justice of the two high courts (one from which the judge is being transferred and the other receiving him).<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">The Supreme Court also ruled that the transfer of high court judges could be resorted to only as an exceptional measure and only in public interest and not by way of punishment.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The transfer of judges is subjected to judicial review but only the judge who is transferred can challenge it.<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\"><b>The Marriage Bill:<\/b><\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><u><b>In News<\/b><\/u><\/span><span style=\"color: #000000;\"><b>: <\/b><\/span><span style=\"color: #000000;\">The Marriages (Compulsory Registration and Prevention of Wasteful Expenditure) Bill was introduced by private members in the Lok Sabha.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><u><b>Private Member\u2019s Bill<\/b><\/u><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Members of parliament other than ministers are called private members and bills presented by them are known as private member&#8217;s bills.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">It can be introduced only with one month&#8217;s prior notice.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Money bill cannot be introduced by a private member, but a constitutional amendment bill can be introduced by a private member.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Till date, only 15 private members&#8217; bills have ever been passed by the Indian Parliament. Six of these were in 1956 alone.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The Rights of Transgender Persons Bill passed in 2015 was the first private member&#8217;s bill to get the upper house&#8217;s approval in the past 45 years.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">In the current Lok Sabha, 588 private bills have already been introduced. <\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Only 11 of them have actually come up for discussion.<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><u><b>The Bill say<\/b><\/u><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The aim of the bill is to\u00a0<\/span><span style=\"color: #000000;\"><b>\u201cprevent extravagant and wasteful expenditure\u201d<\/b><\/span><span style=\"color: #000000;\">\u00a0in weddings.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The bill states that, if a family spends above Rs 5 lakh on a wedding, it should contribute 10% of that amount to a welfare fund that is to be used to facilitate marriages of girls from poor families.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">It seeks to limit the number of guests one can invite and dishes that can be served in weddings.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><u><b>Advantages<\/b><\/u><\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The intention behind is undoubtedly a noble one if the govt welfare fund stays free of corruption and mishandling.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">It could provide the much needed relief to low income families in doing\u00a0<\/span><span style=\"color: #000000;\"><b>social justice<\/b><\/span><span style=\"color: #000000;\">\u00a0to their key life events.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">It will\u00a0<\/span><span style=\"color: #000000;\"><b>encourage simplicity<\/b><\/span><span style=\"color: #000000;\">\u00a0because weddings in India perpetuate a negative social pressure of spending more to show value.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">It would\u00a0<\/span><span style=\"color: #000000;\"><b>ease some pressure of the paying parties\u2019<\/b><\/span><span style=\"color: #000000;\">\u00a0i.e usually the bride\u2019s family, who could possibly be under pressure to spend beyond their comfort levels.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Much of the food and other perishables used in weddings so waste. <\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">This undermines the food security of the country.<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><u><b>Disadvantages<\/b><\/u><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Enforcement on how to celebrate a wedding is not democratic in nature.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">A legal solution for a social issue is often seen as an aggressive policy.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">It will be seen as unnecessary and unwarranted<\/span><span style=\"color: #000000;\"><b>\u00a0government interference in private affairs<\/b><\/span><span style=\"color: #000000;\">.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The mandatory 10% contribution would be perceived as yet another tax levied on the citizens.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The cap of 5 lakhs is a very low amount even to an average urban middle class standard.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The enforcement of the law would also be extremely difficult as it is likely to result in complications of tracking expenses and thus evading the 10% payment.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Regulations will be hard to manage and it will call for a significant state apparatus.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The scope for loopholes is huge. e.g It would be difficult to distinguish weddings from engagements and receptions which are held at an earlier or later date.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Some families see weddings as perfect occasions for reunions and don\u2019t mind investing heavily for once in providing for their guests.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">The bill does not account for the fact that\u00a0<\/span><span style=\"color: #000000;\"><b>weddings are an economic activity for many<\/b><\/span><span style=\"color: #000000;\">\u00a0who work in the
