{"id":2788,"date":"2020-11-03T12:29:20","date_gmt":"2020-11-03T06:59:20","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2788"},"modified":"2020-11-03T12:29:20","modified_gmt":"2020-11-03T06:59:20","slug":"commission-for-air-quality-management","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/commission-for-air-quality-management\/","title":{"rendered":"Commission for Air Quality Management"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News<\/h3>\n\n\n\n<p>A new Commission was formed to track and combat air pollution in\nthe National Capital Region.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail<\/h3>\n\n\n\n<ul><li>The President of India signed the <strong>Ordinance\nfor the Commission for Air Quality Management in Delhi and Adjoining Areas.<\/strong><\/li><li>It will be a <strong>statutory committeeto\ntrack and combat air pollution in and around the National Capital Region.<\/strong><\/li><li>The Commission is aimed at better coordination,\nresearch, identification, and resolving problems surrounding air pollution in\nNorth India.<\/li><li>The new Commission will guide the bodies such as\nstate and central pollution control boards of <strong>Delhi, Uttar Pradesh,\nPunjab, Haryana and Rajasthan.<\/strong><\/li><li>The Commission will have <strong>powers to direct the\nstate governments on issues related to air pollution.<\/strong><\/li><li><strong>Only NGT is authorized to hear cases\nrelated to the Commission. <\/strong><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Composition of the Commission<\/h3>\n\n\n\n<p>It will be an 18-member commission headed by a full-time\nchairperson. <\/p>\n\n\n\n<p>The Chairperson will be a former or serving secretary to the Government\nof India or a Chief Secretary to a state. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The other members include &#8211; <\/h3>\n\n\n\n<ul><li>A representative from the Environment Ministry<ul><li>Five ex-officio members from the States\nmentioned in the Ordinance<\/li><\/ul><ul><li>Two full-time members who are either serving or\nformer joint secretaries<\/li><\/ul><ul><li>A technical member each from the Central\nPollution Control Board and Indian Space Research Organisation<\/li><\/ul><ul><li>One member from Niti Aayog<\/li><\/ul><ul><li>Three independent members<\/li><\/ul><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Role of The Commission<\/h3>\n\n\n\n<ul><li>The new Commission has <strong>powers<\/strong>that are <strong>similar\nto the Environment Pollution (Prevention and Control) Authority (EPCA). <\/strong><\/li><li>The Commission will have state representatives.<\/li><li>According to the new Ordinance States as well as\nCentral Bodies will\nnot have any jurisdiction in\nmatters related to air pollution\nin the states mentioned in the Ordinance.<\/li><li>The Commission will look at the coordination\nbetween the states, planning, execution of policy interventions, inspections,\noperations of industry and research into the causes of pollution.<\/li><li>It will specifically monitor the actions taken\nby the states against stubble burning, industrial emissions, vehicular\nemissions, road dust, biomass burning and construction activities. <\/li><li>The power to issue fines will lie with the new\nCommission. It has the authority to give directions for imprisonment for a\nmaximum of five years and a fine of unto Rs. 1 crore or both. But first, the\noffender must be tried before a first class judicial magistrate.<\/li><li>The Commission also has the power to take up\nmatters suo motu and file a case before a first class magistrate.<\/li><li>The new Commission will erase the relevance of\nstate pollution control bodies as they do not have any power to make decisions.<\/li><li>If a direction is issued by the Commission and\nthe State clashes, the decision of the Commission will be considered.<\/li><li>The Commission has a responsibility to\nmandatorily submit an annual report to the central government on the\naction-taken and research undertaken to tackle air pollution.<\/li><li>The report will be presented before the Parliament.<\/li><li>The Commission also has the power to make\nregulations, but prior approval of the Central Government is required. Further,\nthe regulations must be notified and must be kept before each house of the\nParliament.<\/li><li>The ordinance has empowered the new Commission\nto form Special Investigative Groups for stricter implementation of its\ndirections. This was the major lacuna in Supreme Court formed EPCA.&nbsp; <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">EPCA<\/h3>\n\n\n\n<ul><li><strong>Environment Pollution (Prevention and\nControl) Authority (EPCA) was set up by the orders of the Supreme Court.<\/strong><\/li><li>EPCA is not a statutory body but has the\nauthority to deal with the cases of air pollution as part of the judgment in<strong>\nM C Mehta vs Union of India (1988).<\/strong><\/li><li>EPCA was not supported by a legal framework but\nhas the authority to issue fines, directions and guidelines to the government\nin other states other than Delhi NCR.<\/li><li>EPCA played a crucial role in drafting the\nlong-term <strong>Comprehensive Action Plans (CAP) for combating air pollution.<\/strong><\/li><li>It had only two permanent members and no state\nrepresentatives.<\/li><li>The achievements of EPCA starting 1998 was the\nphase-wise replacement of Delhi\u2019s public\ntransport fleet from diesel to CNG, the rollout of the BS-VI grade fuel and\nemission standards, recommended building two bypasses to move traffic not\ndestined to Delhi.<\/li><li>The BS-VI fuel has 80% less Sulphur content than\nBS-IV.<\/li><li>The two bypass roads are now known as Eastern\nand Western Peripheral Expressways.<\/li><li>Some other measures taken by EPCA include\nsetting up standards for Sulphur dioxide and oxides of nitrogen, ban on pet coke\nand furnace oil in NCR regions and closing the Badarpur power plant in Delhi.<\/li><li>With the promulgation of the Ordinance, the\n22-year old EPCA will be dissolved.<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>In News A new Commission was formed to track and combat air pollution in the National Capital Region.
