{"id":2779,"date":"2020-10-30T16:29:34","date_gmt":"2020-10-30T10:59:34","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2779"},"modified":"2020-10-30T16:29:34","modified_gmt":"2020-10-30T10:59:34","slug":"jammu-and-kashmir-land-laws","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/jammu-and-kashmir-land-laws\/","title":{"rendered":"Jammu and Kashmir Land Laws"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News<\/h3>\n\n\n\n<p>Indian citizens can now buy land in Jammu and Kashmir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail<\/h3>\n\n\n\n<ul><li>Centre notified new land laws for Jammu and\nKashmir, ending the abrogated Article 370.<\/li><li>Now, common people and investors outside J&amp;K\ncan purchase land in the region.<\/li><li>This ended the exclusive rights of locals over\nthe land granted under Article 370.<\/li><li>The new J&amp;K Development Act omitted the term\n\u2018being a permanent resident of the State\u2019 as a\ncriterion to purchase land.<\/li><li>Soon the Centre is going to notify land laws\nseparately for the Union Territory of Ladakh.<\/li><li>According to the amendments of \u2018The Jammu and Kashmir Land Revenue Act, Samvat, 1996\u2019 only agriculturists of the region can buy agriculture\nland and no exchange, sale, gift and mortgage shall be valid by a\nnon-agriculturist.<\/li><li>The Ministry of Home Affairs (MHA) introduced\nthe UT of J&amp;K Reorganization, Adaption of Central Laws, Third Order, 2020\nresulted in the repeal of 26 state laws.<\/li><li>This included the J&amp;K Big Landed Estates\nAbolition Act which resulted in the \u2018Land\nof tiller rights\u2019.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Features of the New Law<\/h3>\n\n\n\n<ul><li>The new law ended the right of permanent\nresidents over land.<\/li><li>Common citizens as well as investors outside\nJ&amp;K can now purchase the land.<\/li><li>Restrictions on conversion of agricultural landsto non-agricultural\npurposes. But&nbsp; a district collector can\nclear the conversion.<\/li><li>For healthcare or higher or senior secondary or\nfor specialized education land can be transferred in favour of a person or an\ninstitution.<\/li><li>For declaring an area as \u201cStrategic Area\u201d for\noperational and training requirements of the armed force, an army officer\nshould be not below the rank of Crops Commander.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Need for the New Laws?<\/h3>\n\n\n\n<ul><li>The changes to the land laws are the logical\nsteps following the nullification of Article 370 and Article 35-A which had\nended the special status for Jammu &amp; Kashmir.<\/li><li>The government argues that the new laws will\nspur economic activity in J&amp;K. It pointed that because of the restrictions\non land purchase that were in place in the erstwhile state, Jammu &amp; Kashmir\nhad little landholdings to attract investors. <\/li><li>But, there are concerns among the local populace\nand local political parties are vehemently opposing the laws. <\/li><li>Some argue that the changes could have been made\nafter consultation with local population. <\/li><li>For so long, the J&amp;K politics had been\ndominated by deliberate demographic engineering. Fears are ripe that this will\nchange now. <\/li><li>The government should also understand that\npushing development in J&amp;K without political participation and people\u2019s deliberations\nwill result in fraught development.<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>In News Indian citizens can now buy land in Jammu and Kashmir.
