{"id":2705,"date":"2020-09-29T16:42:42","date_gmt":"2020-09-29T11:12:42","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2705"},"modified":"2020-09-29T16:42:42","modified_gmt":"2020-09-29T11:12:42","slug":"labour-code-bills-passed","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/labour-code-bills-passed\/","title":{"rendered":"Labour Code Bills Passed"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News<\/h3>\n\n\n\n<p>The Lok Sabha cleared three labour code bills, a major reform\naimed at improving labour laws in the country at the same time facilitating\nindustries to be flexible in hiring and firing workers.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail<\/h3>\n\n\n\n<ul><li>The Lok Sabha has cleared three labour code\nbills with new versions.<\/li><li>The bills include<strong> Industrial Relations Code\nBill, 2020, Occupational Safety and Health and Working Code Bill, 2020 and Code\non Social Security Bill 2020.<\/strong><\/li><li>The government proposes to increase the social\nsecurity by including the gig workers and inter-state migrant workers.<\/li><li>It proposed measures that will provide greater\nflexibility for employers to hire and fire workers without government\npermission.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Key Proposals<\/h3>\n\n\n\n<ul><li>The government has proposed more conditions in\nthe Industrial Relations Code Bill 2020, by restricting the right of workers to\nstrike, an increase in threshold relating to layoffs and retrenchment in\nindustrial establishments having 300 workers from 100 workers or more, to\nprovide more flexibility to employers for hiring and firing workers without\ngovernment permissions.<\/li><li>The Industrial Relations Code Bill has raised\nthe threshold for the requirement of a standard order which enables the\ncompanies to introduce arbitrary service conditions for workers.<\/li><li>States like Rajasthan have already increased the\nthreshold.<\/li><li>According to the Labour Ministry, this rule has\nresulted in an increase in employment and a decrease in retrenchment.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Concerns over New Labour Laws<\/h3>\n\n\n\n<ul><li>Experts say that increase in the threshold may\nwater down the labour rights for workers in the small establishments having\nless than 300 workers.<\/li><li>The new Code also introduces new conditions for\ncarrying out a legal strike.<\/li><li>Before going for a legal strike, the period for\narbitration proceedings has been included in the conditions for workers.<\/li><li>The IR code proposes that no worker should go on\nstrike without a 60-day notice and during the pendency of proceedings before a\nTribunal or a National Industrial Tribunal and sixty days after the conclusions\nof the proceedings.<\/li><li>The Standing Committee on Labour had recommended\nagainst the expansion of the strike beyond the public utility services like\nwater, electricity, natural gas, telephone and other essential services.<\/li><li>Now, a person employed in the public utility\nservices cannot go for a strike unless he gives a notice for a strike within\nsix weeks before going on the strike or 14 of giving such notice.<\/li><li>But the proposed IR code is applicable for all\nthe industrial establishments.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Proposals for Workers<\/h3>\n\n\n\n<ul><li>The IR Code Bill has proposed a worker\nre-skilling fund.<\/li><li>The contributors for the fund are detailed from\nthe employer of an industry amounting to 15 days wages last drawn by the worker\nimmediately before the retrenchment along with the contribution of other\nsources.<\/li><li>The two other Codes have also proposed the\nchanges for expanding social security and inclusion of inter-state migrant\nworkers.<\/li><li>The <strong>Social Security Code proposes the\nNational Social Security Board.<\/strong><\/li><li>The National Social Security Board guides the\ncentral government for formulating suitable schemes.
