{"id":2593,"date":"2020-04-23T11:59:44","date_gmt":"2020-04-23T06:29:44","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2593"},"modified":"2020-04-23T11:59:44","modified_gmt":"2020-04-23T06:29:44","slug":"government-has-brought-in-new-fdi-rules","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/government-has-brought-in-new-fdi-rules\/","title":{"rendered":"Government Has Brought In New FDI Rules"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News<\/h3>\n\n\n\n<p>The Government of India revised its <strong>FDI policy<\/strong> to curb the\n<strong>opportunistic takeovers<\/strong> of the firms due to the impact of COVID-19.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In Detail<\/h3>\n\n\n\n<ul><li>On April 17, the <strong>Department for Promotion of\nIndustry and Internal Trade (DPIIT)<\/strong> revised the FDI policy to curb the\nopportunistic takeovers and acquisitions of Indian firms.<\/li><li>The new FDI revised policy states that <strong>\u201cA non-residential entity or a citizen,\nwhich shares land borders with India can invest only with prior permission from\ngovernment\u201d.<\/strong><\/li><li>The revision is to have a control on FDI from a\nnon-residential entity or a citizen of a country which shares land borders with\nIndia and mainly restricting Chinese firms from acquiring a stake in Indian\ncompanies. <\/li><li>Before the policy revision, countries like Pakistan,\nBangladesh has to undergo government scrutiny. While countries like Sri Lanka,\nMyanmar, Bhutan and Nepal are not major investors.<\/li><li>India has opened most of the sectors of the\neconomy for FDI investmentsvia the automatic route. But sectors like defence,\nspace and atomic energy are prohibited.<\/li><li>The revised policy also mentions that government\npermission is mandatory for any type of FDI investments i.e., Greenfield or\nbrownfield. <\/li><li>Greenfield investments are investing in new\nplants or investing in new production capacity. Brownfield investments are\ninvesting in existing plants.<\/li><li>This policy change is a reference to the\npossibility of Chinese investors purchasing under-valued shares of Indian\ncompanies.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Unintended Problems<\/h3>\n\n\n\n<ul><li>The policy does not distinguish between\ndifferent investments such as industry players, financial institutions and\nventure capital funds. So, such an application may lead to unintended problems.<\/li><li>Making government approval necessary for acquisitions\nin private companies by Chinese investors will reduce potential investors and\nvaluation.<\/li><li>It will also be extremely difficult to mark the\nnationality of venture capital funds or fix the beneficial ownership to the\nfounders of a certain nationality.<\/li><li>In India, companies such as Zomato, Swiggy,\nMakemytrip, Bigbasket, Oyo, Ola and Snap deal are either venture capital funds\nregistered in off-shore or listed in stock exchanges in the US or Hong Kong. <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Opposing China\u2019s\nInvestment in India<\/h3>\n\n\n\n<ul><li>For Chinese investors, India has been an\nattractive destination with a lot of investments in sectors like mobile\ntechnologies and products, automobiles, financial technologies and startups. <\/li><li>Indian MSMEs in the engineering sector has also\nbeen an attractive target for Chinese firms. But, associations of MSMEs are\npleading the government to stop investment into domestic firms.<\/li><li>Chinese investment in India was opposed by many\nIndian companies and groups like Swadeshi Jagaran Manch (SJM).<\/li><li>On April 12, the People\u2019s\nBank of China invested in HDFC and raised its stake to one percent. This\nresulted in a lot of concerns from various sectors and countries.<\/li><li>As is seen the world over, the stock market\nslump brought upon by the COVID-19 pandemic has lowered the stock prices of\nmajor companies, among them are many strategic companies. Chinese state and\nprivate investors, sensing an opportunity are buying stocks in such companies\nand strengthening control in these companies. <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">FDI\nin India<\/h3>\n\n\n\n<ul><li><strong>FDI India<\/strong> acts as an agent that connects\nforeign direct investment opportunities to foreign investors.<\/li><li>It acts as a reference platform that matches\ninvestors with investment and provides easy connectivity with investors.<\/li><li>The FDI in India can be accessed through two\nroutes-<strong>Automatic Route and Government Route<\/strong>.<\/li><li><strong>Automatic Route<\/strong>-Under this route, foreign\ndirect investment is allowed without any government approval.<\/li><li><strong>Government Route<\/strong>-Under this route, before\nmaking an investment government approval is a must. The proposals for\ninvestments are considered by the administrative ministry department.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion<\/h3>\n\n\n\n<p>In the time of the COVID-19 pandemic, Chinese investments are\nseen as an attempt to take over national assets.
