{"id":2548,"date":"2020-04-07T12:47:57","date_gmt":"2020-04-07T07:17:57","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2548"},"modified":"2020-04-07T12:47:57","modified_gmt":"2020-04-07T07:17:57","slug":"domicile-rules-for-jk-defined","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/domicile-rules-for-jk-defined\/","title":{"rendered":"Domicile Rules for J&#038;K Defined"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News <\/h3>\n\n\n\n<p>The Union Government has defined the domicile rules for Jammu\n&amp; Kashmir via a gazette notification.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail <\/h3>\n\n\n\n<ul><li>The new rules were notified to protect the jobs\nof the domiciles in the Group D and other non-gazetted posts.<\/li><li>Under the Section 3A of the J&amp;K\nReorganization (Adaptation of State Laws) Order, 2020, under the J&amp;K Civil\nServices (Decentralization and Recruitment) Act,&nbsp;domicile is now defined\nas those residing in the UT of J&amp;K for a period of 15 years or have studied\nin J&amp;K for seven years and have appeared in class 10th or 12th examination\nin any educational institution located in the UT of J&amp;K or a person\nregistered as a migrant by the Relief and Rehabilitation Commission (Migrants).<\/li><li>As per the notification, the domicile rules are\nfor the purpose of determining who would be eligible for government posts\ncarrying a pay scale of not more than level 4.<\/li><li>The Level 4 posts comprise of gardeners,\nbarbers, office peons, waterman, etc. The highest rank in the category is of a\njunior assistant.<\/li><li>For Group A and Group B posts, the reservation\nof domiciles does not apply. <\/li><li>The definition also includes children of central\ngovernment officials and All India Services Officers.<\/li><li>Also, children of PSU officials and autonomous body of\nCentral Government, Public Sector Banks.<\/li><li>Further, children of officials of statutory\nbodies, officials of Central Universities and recognized research institutes of\nCentral Government are eligible.<\/li><li>All these officials must have served in J&amp;K\nfor ten years or their children must have fulfilled any of the conditions\nnotified in the sections. <\/li><li>Like all other UTs, the recruitment for posts\nwill be carried out by the Union Public Service Commission (UPSC).<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Prior to Notification<\/h3>\n\n\n\n<ul><li>Before the abrogation of Article 35-A of the\nConstitution, the Assembly of J&amp;K has the power to define who is a resident\nof J&amp;K, who were eligible for applying for government jobs, or own\nimmovable property in the state. <\/li><li>With the abrogation of Art 35-A, the MHA issued\nthe notification to secure Level 4 jobs for local residents in UT of J&amp;K.<\/li><li>A reply by MHA in the Parliament revealed that\nthere are 84,000 vacancies in J&amp;K. <\/li><li>Of these, 22,078 are Group IV or level 4 posts\nand 54,375 are non-gazetted posts.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Changes in PSA<\/h3>\n\n\n\n<ul><li>The MHA also issues a notification making\nchanges to the Public Safety Act (PSA).<\/li><li>As per the notification, J&amp;K residents who\nare booked under PSA will be prohibited from lodging in jails outside the Union\nTerritory. <\/li><li>The notification also withdraws all the pension\nbenefits such as car, driver, accommodation, phones, electricity, medical\nfacilities and rent-free accommodation to former J&amp;K Chief Ministers.<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>In News The Union Government has defined the domicile rules for Jammu &amp; Kashmir via a gazette notification.
