{"id":2526,"date":"2020-02-12T12:29:33","date_gmt":"2020-02-12T06:59:33","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2526"},"modified":"2024-06-06T14:53:51","modified_gmt":"2024-06-06T09:23:51","slug":"amended-sc-st-law-upheld","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/amended-sc-st-law-upheld\/","title":{"rendered":"Amended SC\/ST Law Upheld"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News <\/h3>\n\n\n\n<p>The 2018 amendment to the SC\/ST Atrocities law\nhas been upheld by the Supreme Court.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail <\/h3>\n\n\n\n<ul>\n<li>On March 20, 2018, a two-judge\nbench of the Supreme Court in Dr. Subash Kashinath Mahajan vs State of\nMaharashtra declared that there is no absolute bar against granting\nanticipatory bail under the SC\/ST atrocities law if the judicial scrutiny finds\nthat the case is mala fide or if no case is prima facie made out.<\/li>\n\n\n\n<li>As this judgment by the SC will\nmake it easy for SC\/ST culprits to get bail and subvert the case, and also it\nhas diluted the original intention of the SC\/ST Act.<\/li>\n\n\n\n<li>Therefore, the government made\nan amendment to the SC\/ST (Prevention of atrocities) Act of 1989.<\/li>\n\n\n\n<li>The amendment introduced Section\n18A, which reaffirms the original legislative intention that Section 438 CrPC &#8211;\npre-arrest bail &#8211; is not applicable to the accused booked under atrocities Act.\n<\/li>\n\n\n\n<li>The amendment was challenged by\nPrathvi Raj Chouhan and others stating that the amendment is arbitrary in\nnature.<\/li>\n\n\n\n<li>Now, on February 10, 2020, the\nSupreme Court gave its judgment in Prathvi Raj Chouhan case. <\/li>\n\n\n\n<li>The apex court has upheld\nSection 18A of the SC\/ST atrocities act. <\/li>\n\n\n\n<li>However, the three-judge bench\nconsisting of Justices Arun\nMishra, S. Ravindra Bhat, and Vineet Saran stated that a\nHigh Court has an \u2018inherent power\u2019 to grant anticipatory bail prima facie an\noffence under the SC\/ST atrocities act has not been made out. <\/li>\n\n\n\n<li>The Judges further stated that\nthe provision must be used by the High Court in exceptional cases so that the\nprovision is not misused. <\/li>\n\n\n\n<li>Justice S Ravindhra Bhat opined\nthat the chance of filing a false atrocity case is probably high in urban areas\nand the \u2018inherent power\u2019 should be used sparingly by Courts to uphold the\nintention of the Parliament. <\/li>\n\n\n\n<li>He further noted that the\nprovision should not become a norm as it will lead to a miscarriage of justice\nand abuse of the process of law. <\/li>\n\n\n\n<li>He also observed that the\nConstitution and the statutes such as the SC\/ST act are to all humans as equal,\ntheir innate genius is allowed outlets through equal opportunities and each\nindividual is fearless in his\/her pursuit of their dreams. <\/li>\n\n\n\n<li>However, Justice Bhat observed\nthat unless the provisions of the SC\/ST atrocities Act are enforced in the true\nspirit, the dream of an ideal casteless society will be a mirage. <\/li>\n<\/ul>\n\n\n\n<p>Conclusion  The clarification from the Supreme Court is much needed as people from Scheduled Castes and Scheduled Tribes are still being marginalised in many parts of the country. Due to the power of the upper castes, they are able to subvert the judicial system through loopholes in the laws.
