{"id":2514,"date":"2020-01-28T13:02:36","date_gmt":"2020-01-28T07:32:36","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2514"},"modified":"2020-02-07T13:01:19","modified_gmt":"2020-02-07T07:31:19","slug":"supreme-court-for-curbing-powers-of-the-speaker","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/supreme-court-for-curbing-powers-of-the-speaker\/","title":{"rendered":"Supreme Court for Curbing Powers of The Speaker"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News<\/h3>\n\n\n\n<p>In a case pertaining to the disqualification of\nan MLA by the Speaker, the Supreme Court has asked the Parliament to amend the\nConstitution to strip the power of Speaker of Legislative Assembly of\ndisqualifying MLAs under the anti-defection law.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail <\/h3>\n\n\n\n<ul><li>The court called for setting up\nan independent tribunal to adjudicate matters pertaining to disqualification of\nan MLA who has switched sides for money and power.<\/li><li>This is the second time in as\nmany months that the SC has argued against giving powers to the Speakers to\ndisqualify an MLA.<\/li><li>In November last year, the SC,\nin a 109-page judgment held that a speaker who works on the whims and fancies\nof his political party does not deserve to occupy the chair. <\/li><li>The court called on the\nParliament to strengthen the Tenth Schedule to discourage such undemocratic\npractices.<\/li><li>Now, in a 31-page judgment, a\nthree-judge bench questioned why a Speaker, who is a member of a political\nparty and an insider of the house should be the sole and final arbiter in the\ndisqualification of a political defector.<\/li><li>It urged the Parliament to\nrethink the power vested with the Speaker as a quasi-judicial authority while\nbeing a member of a particular political party.<\/li><li>It further questioned why the\ndisqualification procedure under the Tenth Schedule (Anti-defection law) has\nbeen kept in-house rather than giving to an outside authority. <\/li><li>The court reasoned that even\nthe final authority to remove a judge is outside the judiciary with the\nParliament. <\/li><li>Therefore, the court suggested\nthat a disqualification petition under the Tenth Schedule be adjudicated\noutside the Parliament or the Assembly. <\/li><li>It proposed setting up of\nindependent tribunals headed by a retired Supreme Court judge or a retired High\nCourt Chief Justice. <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Tenth Schedule <\/h3>\n\n\n\n<ul><li>Through the 52nd amendment of\nthe Constitution, the tenth schedule was added to the Constitution. <\/li><li>It lays down the process of\ndisqualifying elected representatives on the ground of defection. <\/li><li>The presiding officer of the\nhouse is vested with deciding the disqualification of the representative if\nhe\/she is subject to any of the four grounds mentioned in the Schedule.<\/li><li>The grounds on which an MLA or\nan MP can be disqualified are: <\/li><\/ul>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 1.\nIf the member voluntarily gives up the membership to the political party. <\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2.\nVotes or abstains in contrary to the direction of the political party that\nhe\/she belongs without obtaining permission from the political party.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 3.\nAn independently elected member of the house stated to be disqualified if\nhe\/she joins a political party after the election.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 4.\nWhen a nominated member of the house joins a political party after six months\nof taking the seat.<\/p>\n\n\n\n<ul><li>Initially, when the amendment\nwas brought in 1985, the decision of the presiding officer in deeming a member\nof the house disqualified is final. <\/li><li>In 1992, the Supreme Court gave\njudgment against it and brought the decisions of the presiding under judicial\nreview.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion <\/h3>\n\n\n\n<p>Going a step further from the 1992 judgment, the\nSupreme Court\u2019s reasoning for setting up a tribunal to adjudicate decisions\nregarding the disqualification of a member of the legislative assembly or\nmember of a Parliament is sound.
