It is against fundamental right Article 21\nof the constitution.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail <\/h3>\n\n\n\n<ul>\n<li>In its judgment, the SC opined\nthat the transfer of community commons, especially like village water resources\nto a few people or industries is a violation of Article 21 of the constitution.\n<\/li>\n\n\n\n<li>It also noted that the transfer\nof water resources is not a good idea as many parts of the country are facing\nsevere water stress and access to safe drinking water is still inadequate.<\/li>\n\n\n\n<li>The village common areas are\nthe lifeline of village communities and provide necessary resources for life. <\/li>\n\n\n\n<li>Transferring them will thus\nviolate the fundamental right of right to life provided under Article 21 of the\nConstitution.<\/li>\n\n\n\n<li>The court also stated that the\nstate government concerned cannot take away the existing water source from the\nvillagers even if it promises an alternative site for a water body. <\/li>\n\n\n\n<li>Such attitude, the Court noted,\nwould amount to \u201ca mechanical application of environmental protection.\u201d<\/li>\n\n\n\n<li>It further added that damage\ndone to the existing water body could be offset and people would travel miles\nto access the alternative site.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">The Case<\/h3>\n\n\n\n<ul>\n<li>The Supreme Court gave the\njudgment pertaining to a plea filed by activist-lawyer Jitendra Singh over the\ntransfer of village ponds in the National Capital Region to some private\nindustrialists by the Greater Noida Industrial Development Authority.<\/li>\n\n\n\n<li>The activist approached the SC\nwhen the National Green Tribunal (NGT) refused to take the plea that heavy\nmachinery and excavators are trying to take-over a pond. <\/li>\n\n\n\n<li>The apex court set aside the\ntribunal\u2019s order and directed the authorities and the industrialists to remove\nall obstructions and restore the water bodies within three months.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion <\/h3>\n\n\n\n<p>This is one of the\nimportant judgments to be proclaimed by the Supreme Court. In our country, the\nsight of government authorities goes towards village commons whenever there is\ntalk of development. <\/p>\n\n\n\n<p>As the Court noted,\nthese areas provide an essential livelihood for many village people.\nTransferring them for private people in the name of development is cruel and\nhampers the life of these people. It is thus a violation of Article 21, as the\ncourt noted. <\/p>\n\n\n\n<p>Though the government provided protections to village commons, these remained on paper since independence. Powerful people and corrupt systems have exploited these resources at will.
