The furore is over the nature of\nthe Bill. It aims to provide Indian Citizenship to people based on religion. <\/p>\n\n\n\n<p>Here are the details. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">The Citizenship Amendment Bill <\/h4>\n\n\n\n<ul><li>The Bill passed in the Lok\nSabha seeks to provide those persecuted people or illegal migrants of Hindu,\nSikh, Parsi, Buddhist and Christian from Pakistan, Afghanistan and Bangladesh,\nwho have lived in the country without valid documents will be given Indian\ncitizenship within 6 years. <\/li><li>The current criteria to get\nIndian citizenship through naturalisation is 12 years of residence in the\ncountry. <\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Government\u2019s Logic Behind the Bill<\/h4>\n\n\n\n<ul><li>The government states that it\nhas brought the bill as these minority groups are being persecuted in\nMuslim-majority nations. <\/li><li>The logic is dumbfounded as\nHindus and Rohingya Muslims are persecuted in Myanmar, Tamils in Sri Lanka and\nAhmed Shias in Pakistan.<\/li><li>But, the government included in\nthe Bill only certain religions and from certain countries only. <\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Is The Bill Constitutionally Valid?<\/h4>\n\n\n\n<ul><li>The Bill, by allowing only\npeople from certain religions to take Indian citizenship is pushing the Muslim\ncommunity to be second-class citizens. <\/li><li>This is in violation of the\nConstitution\u2019s Article 14, the right to equality of all persons.<\/li><li>Any Act of Parliament cannot\nreshape the basic structure of the Constitution. Yet, the government opines\nthat the Bill does not do that.<\/li><li>Only the Supreme Court can\nrespond to this once the bill becomes an Act. <\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">North-East Conundrum <\/h4>\n\n\n\n<ul><li>The states from the North-East\nregion of the country vehemently opposed the CAB.<\/li><li>Due to this, most of the states\nthat fall under the sixth schedule of the constitution and have Line of Permit\nsystem in place are left out of the Bill.<\/li><li>That means any person declared\nas a foreigner in these areas cannot enter these areas even he\/she is from the\nabove-mentioned religions. <\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">The Sixth Schedule <\/h4>\n\n\n\n<ul><li>All of Meghalaya and Mizoram\nand parts of Assam and Tripura fall under the Sixth schedule.<\/li><li>The schedule provides special\nprovisions of administration in these tribal areas.<\/li><li>The CAB exemptions for these\nstates apply to only areas that are under the sixth schedule.<\/li><li>That means in Assam only\ntribal-majority areas of Dima Hasao, Karbi Anglong, and Bodoland Territorial\nArea Districts are exempt from CAB.<\/li><li>This is the reason behind\nviolent protests in Assam where already there is an incendiary politics of\nidentity.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">The Inner Line Permit System<\/h4>\n\n\n\n<ul><li>The Inner Line Permit (ILP)\nsystem was drawn from a colonial-era law &#8211; the &nbsp;Bengal Eastern Frontier Regulation, 1873. <\/li><li>As per the system, to enter the\nareas that fall under the system &#8211; Arunachal Pradesh, Nagaland, and Mizoram &#8211;\noutsiders, even Indian citizens need an ILP.<\/li><li>Only people from indigenous\ncommunities can own land and settle in these areas. <\/li><li>Due to this, the government\nexempted these places from CAB.<\/li><li>Manipur is also now exempted\nfrom CAB.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Nation-Wide NRC <\/h4>\n\n\n\n<ul><li>The government now wants to\nconduct a nation-wide National Register of Citizens (NRC) as the one that was\ncarried out in Assam. <\/li><li>But, the Assam experience shows\nthat the exercise led to arbitrariness and mass exclusion.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Conclusion<\/h4>\n\n\n\n<p>With the automatic immunity provided to Hindus,\nSikhs, Parsis, Buddhists and Christians under CAB, one can only expect mass\nrights-stripping and isolation of Muslims in the country.<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>The Citizenship Amendment Bill (CAB) is creating a storm in both the Parliament and outside it.
