{"id":2361,"date":"2019-11-22T13:15:16","date_gmt":"2019-11-22T07:45:16","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2361"},"modified":"2019-11-22T13:15:16","modified_gmt":"2019-11-22T07:45:16","slug":"all-about-the-industrial-relations-code-bill-2019","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/all-about-the-industrial-relations-code-bill-2019\/","title":{"rendered":"All About The Industrial Relations Code Bill, 2019"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In\nNews<\/h3>\n\n\n\n<p>The Union Cabinet has approved the Industrial Relations Code Bill\nthat would amalgamate The Trade Unions Act, 1926, The Industrial Employment\n(Standing Orders) Act, 1946 and the Industrial Disputes Act, 1947.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail<\/h3>\n\n\n\n<ul><li>The Industrial Relations Code\nis one of the four codes that the government has proposed in order to codify\nCentral labour laws. <\/li><li>The Parliament has already\napproved the Code on Wages, 2019. <\/li><li>The Occupational Safety, Health\nand Working Conditions Code has been introduced in the Lok Sabha earlier this\nyear. <\/li><li>This is the third code in the\nline that has passed through inter-ministerial consultations and is set to be\nintroduced in the Parliament.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Important\nAspects of The Bill<\/h3>\n\n\n\n<ul><li>The Bill provides a degree of\nflexibility in government approvals for the retrenchment of employees.<\/li><li>It presents a legal framework\nfor ushering in the concept of \u2018fixed-term employment\u2019 through contract workers\non a pan-India basis.<\/li><li>While companies currently hire\ncontract workers through contractors, the fixed-term employment concept allows\nthe companies to hire contract workers directly.<\/li><li>It also allows for tweaking of\nthe contract term based on the seasonality of the industry.<\/li><li>During the contract tenure, the\nworkers will be treated on par with regular workers. <\/li><li>It helps the companies to hire\nand fire workers easily and also provides social security to contract workers.<\/li><li>Contract workers will now be\neligible for getting PF, gratuity, medical benefits, etc., similar to regular\nworkers during their contract periods.<\/li><li>By placing the concept in the\ncentral bill, the government is expecting that it will have a wider reach and\nstates will follow suit. <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Other\nChanges <\/h3>\n\n\n\n<ul><li>Amid opposition from trade\nunions over raising of the threshold for retrenchment to 300 employees for\ngovernment permission in the draft bill, the government has retained the\nearlier provision of 100 employees threshold for government permission in the new\nbill. <\/li><li>But, it has now given the\nflexibility to increase or decrease the threshold via a notification.<\/li><li>The Industry has often sited\nthe rigidity in laying off employees in the current labour laws that are\nlimiting scalability and employment generation.&nbsp;\n<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Opposing\nthe Bill<\/h3>\n\n\n\n<ul><li>Critics to the Bill argue that\nthe unclear provision of retrenchment may lead to discretionary behaviour\nduring implementation by the Central or State government.<\/li><li>They argue that the fixed-term\nemployment needs to be implemented with adequate safeguards as it may lead to\nturning permanent employment into fixed-term employment.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Cheering\nthe Bill<\/h3>\n\n\n\n<ul><li>Retrenchment has been a major\nhurdle for the industry with the existing labour laws.<\/li><li>With the flexibility provided\nin the new Bill, the industry is welcoming the Bill. <\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>In News The Union Cabinet has approved the Industrial Relations Code Bill that would amalgamate The Trade Unions Act, 1926, The Industrial Employment (Standing Orders) <a class=\"mh-excerpt-more\" href=\"https:\/\/www.classiciasacademy.com\/blog\/all-about-the-industrial-relations-code-bill-2019\/\" title=\"All About The Industrial Relations Code Bill, 2019\">    [read more]<\/a><\/p>\n<\/div>","protected":false},"author":1,"featured_media":2362,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[98],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v22.9 -
