{"id":2340,"date":"2019-11-18T14:49:17","date_gmt":"2019-11-18T09:19:17","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2340"},"modified":"2019-11-18T14:49:17","modified_gmt":"2019-11-18T09:19:17","slug":"rules-on-tribunal-postings-struck-down","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/rules-on-tribunal-postings-struck-down\/","title":{"rendered":"Rules On Tribunal Postings Struck Down"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">In\nNews <\/h2>\n\n\n\n<p>The Supreme Court has struck down the rules pertaining to tribunal\npostings passed in the Finance Act, 2017. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">In-Detail\n<\/h2>\n\n\n\n<ul><li>The Finance Act, 2017 had\nprovisions relating to the terms and conditions of appointments and services of\nmembers of judicial tribunals. <\/li><li>In a case that is questioning\nthe constitutionality of terming the Finance Act, 2017 as Money Bill by the Lok\nSabha Speaker, the supreme court bench of justices has struck down the\nprovisions related to tribunals as unconstitutional. <\/li><li>The apex court argued that the\nprovisions in the Act suffered from various infirmities. <\/li><li>It further noted that the\ncontrol of various facets of judicial tribunals by the Central government would\naffect judicial independence. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">On\nthe Case<\/h2>\n\n\n\n<ul><li>The Supreme Court, in a\nmajority judgment, has sent the case itself to a larger bench. <\/li><li>The case questions the act of\nthe Lok Sabha speaker in allowing the Finance Act, 2017 as a Money Bill.<\/li><li>But, Justice Chandrachud of the\nbench dissented to send the case to a larger bench. <\/li><li>He noted that there is no bar\non the SC to judicially review the discretion power of the Speaker in\ncertifying a bill as a money bill. <\/li><li>He also noted that certifying a\nbill as a money bill to circumvent Rajya Sabha is unwanted as Rajya Sabha\npresents the pluralism of the Indian Constitution.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Directing\nLaw Ministry <\/h2>\n\n\n\n<ul><li>The Judgment direct the Law\nMinistry to re-formulate rules on the services and conditions of the members in\nsix months. <\/li><li>There will not be any\ndiscrimination among the members of the tribunals and the Court wanted All the\nmembers of the tribunals to be treated as a homogenous class. <\/li><li>The Court also directed the\ngovernment to conduct a judicial impact assessment of the workings of the\ntribunals.<\/li><li>It wanted to limit direct\nappeals to the Supreme Court from the tribunals. <\/li><\/ul>\n\n\n\n<p>\n\n\n\n\n\n\n\nThe assessment will also help the government see\nwhether there are adequate benches for the tribunals\n\n\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>In News The Supreme Court has struck down the rules pertaining to tribunal postings passed in the Finance Act, 2017.
