{"id":2338,"date":"2019-11-18T14:30:39","date_gmt":"2019-11-18T09:00:39","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2338"},"modified":"2019-11-18T14:30:39","modified_gmt":"2019-11-18T09:00:39","slug":"cji-office-comes-under-rti-act","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/cji-office-comes-under-rti-act\/","title":{"rendered":"CJI Office Comes Under RTI Act"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">In\nNews<\/h2>\n\n\n\n<p>A five-judge Constitution bench of the Supreme Court has delivered a\nlandmark judgment on the office of the Chief Justice of India by placing it\nunder the Right to Information Act. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">In-Detail\n<\/h2>\n\n\n\n<ul><li>In order to ensure the\ntransparent functioning of the highest judicial office of the country, the\nSupreme Court bench in its judgment stated that the office of the Chief Justice\nof India is a \u2018Public Authority\u2019 under the RTI act. <\/li><li>As Supreme Court is an\ninstitution of public authority, the office of the CJI which is a part and\nparcel of that institution is also a public authority and hence comes under the\nRTI Act. <\/li><li>The Court also approved that\nthere is no threat to judicial independence due to increased transparency under\nthe RTI.<\/li><li>One of the judges on the bench\nobserved that \u201cjudicial independence is not secured by the secrecy of cloistered\nhalls\u201d.<\/li><li>On a cautious note, one judge\nobserved that the public reposes faith in the judiciary due to its independence.\nThus, transparency to a certain extent must be calibrated with judicial\nindependence. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Not\nAbsolute<\/h2>\n\n\n\n<ul><li>In a unanimous voice the bench\nhas ruled that the right to know under RTI is not absolute.<\/li><li>It stated that RTI must be\nbalanced with the privacy of the individual judges. <\/li><li>RTI should not be used as a\ntool for surveillance on the judges.<\/li><li>Thus, the Court ruled that the\npersonal information of the judges shall not be provided under RTI.<\/li><li>Section 8(1)(j) under the RTI\nAct states that divulging personal information is in the discretionary power of\nthe Public Information Officer (PIO).<\/li><li>Also, the judgment has ruled\nthat information about a judge\u2019s assets, official communication during the\ntimes of elevation of judges must be treated as confidential third-party\ninformation and the PIO must act according to Section 11 of the RTI Act. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion\n<\/h2>\n\n\n\n<p>This a landmark judgment allowing for greater transparency in the\nfunctioning of the Judiciary. The judgment also tackled the privacy concerns of\nthe judges. By not making RTI absolute, considerable caution has been taken and\nrightly so. At a time when, RTI, though a great tool for transparency, is being\nmisused for witch-hunting.
