{"id":2281,"date":"2019-10-23T12:25:48","date_gmt":"2019-10-23T06:55:48","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2281"},"modified":"2024-06-06T15:20:46","modified_gmt":"2024-06-06T09:50:46","slug":"defining-forest-states-have-the-final-say","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/defining-forest-states-have-the-final-say\/","title":{"rendered":"Defining Forest &#8211; States Have The Final Say"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News<\/h3>\n\n\n\n<p>The Forest Advisory Committee (FAC) of the\nEnvironment Ministry has clarified that the States need not get the approval of\nthe Ministry of Environment, Forest and Climate Change (MoEF&amp;CC) in\ndefining unclassified lands as forests. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail<\/h3>\n\n\n\n<ul>\n<li>The issue of classifying lands\nas forests are in consideration with the MoEF&amp;CC since 2014. <\/li>\n\n\n\n<li>It has prepared various drafts,\nbut none have been made public. <\/li>\n\n\n\n<li>The clarification from the FAC\nputs an end to the issue.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">States\u2019 Prerogative<\/h3>\n\n\n\n<ul>\n<li>Since 1996, it is the\nprerogative of the States to define land as forest land. <\/li>\n\n\n\n<li>The Supreme Court in the\nGodavarman judgment of 1996 gave states the freedom to define land.<\/li>\n\n\n\n<li>The apex Court expanded the definition\nof forest land to include forest lands notified by the central government,\nthose that are in the government records and those that are in consonance with\nthe dictionary definition of forests.<\/li>\n\n\n\n<li>With the last part of the\njudgment, the states were allowed to set their own criteria and define forest\nlands thereby making these lands bound to forest conservation laws. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Deemed Forests <\/h3>\n\n\n\n<ul>\n<li>But, not all states have used\nthe clause to notify an area as forest land. <\/li>\n\n\n\n<li>Those that have been notified\nusing the clause are termed as \u2018Deemed Forests\u2019.<\/li>\n\n\n\n<li>Only 1% of forest lands across\nthe country have been notified as deemed forests.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Why The Clarification Now? <\/h3>\n\n\n\n<ul>\n<li>At a meeting to deliberate on\ngranting permission for industries to fell trees (as FAC is the apex body to\ndiscuss such matters). <\/li>\n\n\n\n<li>The Uttarakhand government has\nasked the opinion of the FAC to a set of criteria that it has put forth to\ndefine forest land.<\/li>\n\n\n\n<li>For this, the FAC noted that\nstates with well-established forest departments that have a good understanding\nof their forests can frame their own rules for defining forest land and need\nnot get the approval of the MoEF&amp;CC.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion <\/h3>\n\n\n\n<p>In India, an all-encompassing definition of forest is not possible. There are 16 different types of forests in the country. While in one state a grassland can be deemed a forest and in others, it may not be. Thus, allowing the states to set their own criteria is significant. Also, when a state deems a land as a forest, the decision cannot be reversed.
