{"id":2267,"date":"2019-10-03T13:21:31","date_gmt":"2019-10-03T07:51:31","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2267"},"modified":"2019-10-05T10:39:10","modified_gmt":"2019-10-05T05:09:10","slug":"supreme-courts-recall-its-sc-st-atrocities-judgement","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/supreme-courts-recall-its-sc-st-atrocities-judgement\/","title":{"rendered":"Supreme Courts Recall its SC\/ST Atrocities Judgement"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News <\/h3>\n\n\n\n<p>The Supreme Court has recalled its March 20, 2018 judgment on\nSC\/ST atrocities Act calling that the judgment was against basic human dignity.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail <\/h3>\n\n\n\n<ul><li>On March 20, the Supreme Court bench headed by\nJustice Goel gave a verdict that diluted the SC\/ST Prevention of Atrocities Act\nwhich led to large scale protests and the central government had taken\nordinance route to bring back the original provisions.<\/li><li>Justice Goel (now retired) allowed accused\npersons to be granted anticipatory bail and directed the police to conduct a\npreliminary inquiry to check whether the complaint was filed with a mala fide\nintent.<\/li><li>The two conditions of the judgment were not part\nof the original provisions of the SC\/ST Act. <\/li><li>He further noted that the Act is being misused\nto lodge false complaints leading to the arrest of innocent persons. <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Judgment Recalled <\/h3>\n\n\n\n<ul><li>Recalling the March 20, 2018 judgment, the SC\ncondemned its earlier judgment calling it to be against basic human dignity to\ntreat all SC\/ST community members as \u201ca liar or crook\u201d.<\/li><li>The review petition was filed by the Government.<\/li><li>The judgment further noted that the SC\/ST\ncommunity, owing to their backwardness, do not muster the courage to lodge an\nFIR against upper-caste persons, much less a frivolous one. <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Review of A Judgment <\/h3>\n\n\n\n<ul><li>A review of SC judgment means that the same\nbench will review its judgment. <\/li><li>This is opposed to \u2018overview\u2019 where a higher\ncourt can alter the judgment of a lower court. It also allows the law to change\nin one case can be overruled in another case by a higher court. <\/li><li>In the current case, as the judges who passed\nthe March 2018 judgment was retired, the case was referred to a higher\nthree-judge bench.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">The SC\/ST Act <\/h3>\n\n\n\n<ul><li>The SC\/ST act was enacted in 1989.<\/li><li>It was enacted to further the abolition of\nuntouchability (Article 17) and equality under the Constitution (Articles 14,\n15). <\/li><li>The Scheduled Castes and Scheduled Tribes of the\ncountry have faced various offenses, humiliations, indignities by the people of\nupper castes. <\/li><li>For the current judgment, the SC bench took into\nconsideration the Statement of Objects &amp; Reasons of the Bill. <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion <\/h3>\n\n\n\n<p>The SC has rightly recalled its previous judgment. For thousands of years, the SC\/ST community has been the most suppressed sections of the country.
