{"id":2062,"date":"2019-08-14T12:23:36","date_gmt":"2019-08-14T06:53:36","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2062"},"modified":"2024-06-07T17:38:41","modified_gmt":"2024-06-07T12:08:41","slug":"panel-for-tax-on-csr-spend","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/panel-for-tax-on-csr-spend\/","title":{"rendered":"Panel For Tax on CSR Spend"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News<\/h3>\n\n\n\n<p>The High Level Committee on Corporate Social Responsibility (CSR)\nconstituted by the Finance Ministry has recommended a tax on CSR spend. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail<\/h3>\n\n\n\n<ul>\n<li>The committee headed by Corporate Affairs\nSecretary Injeti Srinivas suggested that CSR spends should become eligible for\ntax deduction under income tax law. <\/li>\n\n\n\n<li>Currently, income tax law does not apply to CSR\nexpenses. <\/li>\n\n\n\n<li>This comes at a time the central government has\nrecently amended the Company Law to make CSR spend mandatory for companies and\nmaking it a criminal offence in case of non-compliance. <\/li>\n\n\n\n<li>The Committee was constituted to review the\ncurrent CSR framework and suggest ways to strengthen the CSR ecosystem\nincluding implementation, monitoring and evaluating. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Other Recommendations <\/h3>\n\n\n\n<p>The Committee also recommended <\/p>\n\n\n\n<ul>\n<li>Provision for carrying forward of unspent\nbalance for a period of 3-5 years.\n<ul>\n<li>Aligning schedule VII with the Sustainable\nDevelopment Goals (SDGs) by adopting an SDG plus framework. The Framework\nincludes sports promotion, the welfare of differently-abled persons, heritage\nprotection, Senior Citizens\u2019 welfare, and disaster management.<\/li>\n\n\n\n<li>Balancing local area preferences with national\npriorities.<\/li>\n\n\n\n<li>Impact assessment studies for CSR obligation\nthat are exceeding more than Rs. 5 crores.<\/li>\n\n\n\n<li>Registration of implementation agencies on MCA\nportal.<\/li>\n\n\n\n<li>Develop a CSR portal for connecting\ncontributors, agencies and beneficiaries.<\/li>\n\n\n\n<li>CSR in social benefit bonds.<\/li>\n\n\n\n<li>Promoting social impact companies. <\/li>\n\n\n\n<li>Third-party assessment of major CSR projects. <\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The committee is not in favour of treating CSR\nas a resource gap funding for government schemes. <\/li>\n\n\n\n<li>It also does not want CSR contribution into\nvarious funds under Schedule VII of the Companies Act.<\/li>\n\n\n\n<li>It wants CSR to be a board-driven process and\nfind innovative technological solutions for social problems. <\/li>\n\n\n\n<li>The Committee does not want a company to\nconstitute a CSR committee if its CSR contribution is below RS. 50 lakh.<\/li>\n\n\n\n<li>It recommended making violation of a CSR\ncompliance a civil offence.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion <\/h3>\n\n\n\n<p>Penalizing for non-compliance appears to be a regressive approach.
