{"id":2024,"date":"2019-08-06T16:47:10","date_gmt":"2019-08-06T11:17:10","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2024"},"modified":"2019-08-06T17:01:47","modified_gmt":"2019-08-06T11:31:47","slug":"the-hindu-editorial-analysis-a-wrong-way-to-end","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/the-hindu-editorial-analysis-a-wrong-way-to-end\/","title":{"rendered":"The Hindu Editorial Analysis : A Wrong Way to End"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong>Context: <\/strong><\/h3>\n\n\n\n<ul><li>On Monday,\nHome Minister Amit Shah brought two bills before the Rajya Sabha, regarding the\nchange in the status of Jammu and Kashmir and bifurcation of state into two\nunion territories. The widely appreciated step raises some less discussed\nconcerns about the manner in which it was carried out.<\/li><li>The State\nof Jammu and Kashmir is divided into <strong>two\nunion territories: Jammu and Kashmir (with legislature) and Ladakh (without\nlegislature).<\/strong><\/li><li><strong>The state is stripped of its special status as\nautonomous state by revoking Article 370.<\/strong> This means all the provisions of Indian Constitution will apply on the\nnow divided Union Territories. <\/li><li><strong>Article 35A, which emerges from Article 370,\nnaturally becomes void<\/strong>. Now\nthe people of India can have property rights in Jammu and Kashmir region.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The legal fiction:<\/strong><\/h3>\n\n\n\n<ul><li>It would not be incorrect to say that the government used article 370 to destroy itself. Under the provision of clause 3 of Article 370, <strong>the president is empowered to declare the provisions of <a href=\"https:\/\/www.classiciasacademy.com\/blog\/articles-370-and-35a-have-been-scrapped\/\">Article 370<\/a> inoperative with the recommendation of Constituent Assembly of the state.<\/strong><\/li><li>It is important to note that a <strong>constituent assembly is a constitution-making body, whereas a legislative assembly merely functions according to the procedure laid by the constitution.<\/strong> So the evening up the constituent assembly with the legislative assembly raises a question.<\/li><li>However, the Constituent Assembly (like the legislative assembly) was meant to represent the opinion of the people of the state. Since the state is currently under President&#8217;s rule, It leads us to a larger question<strong>: Can the governor, who is not an elected representative but merely an agent of the centre, be equated to the legislative assembly under the provisions of the Article<\/strong>?<\/li><li>Similarly<strong>, Article 3 of the Indian Constitution says, a bill which seeks to change the name or alter the area of a state must be referred to the Legislature of the concerned state by the President<\/strong>. In the present case of bifurcation of the state of J&amp;K into two union territories, this basic principle of federalism is not properly followed.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>On the ground:<\/strong><\/h3>\n\n\n\n<ul><li>The\nconflations of legal definitions, however, are of far less significance than\nthe moral burden that the decision bears by the virtue of its exercise. <strong>Not only the people of the state were kept\nin dark about a decision which they are the subject of, but the leaders of two\nmajor parties of the state were also put in house arrest<\/strong>. The state has\nbeen cordoned off by the forces and the bill has been laid before the\nparliament in a very surreptitious manner. <\/li><li>The\ngenuine intention of the government, of assimilation and development of a\nhitherto isolated region, is in moral jeopardy due to the manner of\nimplementation. It further questions its legitimacy of the whole process in the\ninternational community.<\/li><\/ul>\n\n\n\n<ul><li><strong>The strategic significance:<\/strong><\/li><\/ul>\n\n\n\n<ul><li><strong>The decision should also be viewed as an\nimportant strategic development against the backdrop of U.S. President Trump\u2019s\nrecurring statements on his desire to mediate on Kashmir<\/strong>. Since the special status of the state is\nrevoked, it sends the message that there is no disputed area to mediate.\nFurther<strong>, Washington has recognized the\ndecision as \u2018India\u2019s internal matter<\/strong>\u2019, which is a clear hard hit to\nPakistan.<\/li><\/ul>\n\n\n\n<p><strong>Conclusion:<\/strong><\/p>\n\n\n\n<ul><li>The\nabrogation of Article 370 and 35A is winning move for the government both in\ninternal and international politics. The move will most likely be challenged in\nthe Supreme Court for its validity. In the meantime, <strong>to tackle the rage and frustration of Kashmiri people effectively and\nreplace the separatist mindset with that of development should be the\ngovernment\u2019s top priority<\/strong>.<\/li><li><strong>This\ndrastic development can only be judged by its outcomes<\/strong>. It is yet to see if the step will bring the\nregion to mainstream India or it will further intensify separatism on the\nground level.
