{"id":2015,"date":"2019-08-06T12:35:50","date_gmt":"2019-08-06T07:05:50","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2015"},"modified":"2024-06-07T16:55:52","modified_gmt":"2024-06-07T11:25:52","slug":"surrogacy-and-transgender-bills-have-been-passed","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/surrogacy-and-transgender-bills-have-been-passed\/","title":{"rendered":"Surrogacy and Transgender Bills Have Been Passed"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News <\/h3>\n\n\n\n<p>The Lok Sabha has passed two legislations, one to regulate\nsurrogacy and the other is to provide rights to transgenders in the country. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Surrogacy Bill<\/h3>\n\n\n\n<ul>\n<li>The Union Health Minister has introduced the\nSurrogacy (Regulation) Bill, 2019&nbsp;in the Lok Sabha. <\/li>\n\n\n\n<li>The Bill seeks to ban commercial surrogacy in\nthe country, plans to regulate the process of surrogacy and provide the right\nto the children born out of surrogacy.<\/li>\n\n\n\n<li>There are an estimated 3000-4000 illegal\ncommercial surrogacy clinics in the country. Cases were the abandonment of\nchild born out of surrogacy have come out leading the government to bring in\nthe legislation to regulate surrogacy.&nbsp; <\/li>\n\n\n\n<li>Surrogacy, as per the Bill is the practice where\na woman willingly gives birth to a child for eligible couple and hands over the\nchild after birth. <\/li>\n\n\n\n<li>The Bill bans commercial surrogacy and regulates\naltruistic surrogacy. <\/li>\n\n\n\n<li>In an altruistic surrogacy, monetary benefits\nare in the form of medical expenses and insurance coverage for the surrogate\nmother. <\/li>\n\n\n\n<li>As per the Bill, only Indian couples who have\nbeen legally married for five years are allowed for surrogacy. The age of the\ncouples should be between 23-50 years for male and 26-55 years for female.<\/li>\n\n\n\n<li>The surrogate must be a close relative to the\ninfertile couple. <\/li>\n\n\n\n<li>National Surrogacy Board, State Surrogacy Boards\nand appropriate authorities will be formed to regulate surrogacy.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Transgender Persons (Protection of Rights) Bill 2019&nbsp;<\/h3>\n\n\n\n<ul>\n<li>The Bill seeks to provide economic, social and\neducational rights for transgender persons across the country. It will benefit\nover 4 lakhs of transgender persons. <\/li>\n\n\n\n<li>The Bill defines a transgender person as those\nwhose gender does not match with that assigned at birth and include trans-man\nand trans-woman (irrespective of the person undergoing any sex-change\nsurgeries), a person with inter-sex variations, those who have been cultural identities\nas Hijra, Kinner, jogta and aravani, and also gender-queer person.<\/li>\n\n\n\n<li>The bill allows the person to choose the gender.\n<\/li>\n\n\n\n<li>They have to first get certified as transperson\nby going through a district screening committee and district magistrate.<\/li>\n\n\n\n<li>Aa per the Bill, a national authority for\nsafeguarding rights of transgenders will be established. <\/li>\n\n\n\n<li>There are provisions for penalty and punishment\nfor cases of sexual harassment and offences against transgenders. <\/li>\n\n\n\n<li>A contentious provision of criminalising begging\nby transgender people has been removed from the Bill. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion <\/h3>\n\n\n\n<p> The Transgender Bill is the much-needed one to bring them into the mainstream. They are one of the most disadvantageous communities in the country. Only a few states in the country have given certain rights for transgender persons to lead a normal life. Otherwise, they are mostly seen begging.
