{"id":2012,"date":"2019-08-05T17:43:57","date_gmt":"2019-08-05T12:13:57","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2012"},"modified":"2024-06-06T14:57:34","modified_gmt":"2024-06-06T09:27:34","slug":"articles-370-and-35a-have-been-scrapped","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/articles-370-and-35a-have-been-scrapped\/","title":{"rendered":"Articles 370 and 35A have been scrapped"},"content":{"rendered":"\n<p><strong>Context: <\/strong><\/p>\n\n\n\n<p>The government decision to repeal Article 370, 35A, and to make J&amp;K and Ladakh Separate Union Territories<\/p>\n\n\n\n<p><strong>The Proposal: <\/strong><\/p>\n\n\n\n<ul>\n<li>The Union\ngovernment moved a resolution in the Rajya Sabha to repeal Article 370 in Jammu\nand Kashmir, removing the special status granted to the state. Also, a bill has\nbeen proposed to bifurcate the state of J&amp;K into two Union territories &#8211; <strong>Jammu\nand Kashmir (with a legislature)<\/strong>, and <strong>Ladakh (without a legislature).<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>Understanding Article 370: <\/strong><\/p>\n\n\n\n<ul>\n<li>The state of Jammu and Kashmir became part of Indian Dominion by signing the <strong>&#8216;Instrument of Accession of Jammu and Kashmir to India&#8217;<\/strong>. Under this, the state surrendered<strong> only three subjects (defence, external affairs, and communications)<\/strong> to the Dominion of India. <\/li>\n\n\n\n<li>In pursuance of that, <a href=\"https:\/\/www.classiciasacademy.com\/blog\/the-hindu-editorial-analysis-a-wrong-way-to-end\/\">Article 370<\/a> was incorporated in the Constitution of India. Article 370 under Part XXI of the Indian Constitution is a <strong>\u201ctemporary provision\u201d<\/strong> which grants special autonomous status to Jammu and Kashmir.<\/li>\n\n\n\n<li>Under Article 370, the provisions of Article 238 (dealing with the administration of Part B states) are not applicable to the state of J&amp;K.<\/li>\n\n\n\n<li>Further, Article 370 limits the powers of parliament to make laws for the state to (a) only those matters in the Union List and the Concurrent List which correspond to matters specified in the state\u2019s Instrument of Accession; (b) Such other matters in the Union List and the Concurrent List which are specified by the President with the concurrence of the state government. This means that laws can be made on these matters only with the consent of the State of J&amp;K.<\/li>\n<\/ul>\n\n\n\n<p><strong>Article 35A: <\/strong><\/p>\n\n\n\n<ul>\n<li>Article-35A had\nbeen inserted via the Constitution (Application to J&amp;K) Order, 1954. It was\nissued by the then President under Article 370. <\/li>\n\n\n\n<li>It empowers the\nJammu and Kashmir state legislature to define the persons who are permanent\nresidents of the state and confer any <strong>special rights and privileges in\nmatters of employment under the state government<\/strong>, acquisition of\nimmovable property in the state, settlement in the state and scholarships and\nsuch other forms of aid provided by the state government. <\/li>\n<\/ul>\n\n\n\n<p><strong>Why Articles 370 and 35A should be\nscrapped?<\/strong><\/p>\n\n\n\n<ul>\n<li>In 1947, Kashmir,\nunlike other princely states, was not ripe for integration. The conditions in\nthe Jammu and Kashmir were abnormal due to the ongoing war between India and\nPakistan over the state. And yet there was hope that J&amp;K would one day\nintegrate like other States of the Union. <\/li>\n\n\n\n<li>Article 370 was\nabout providing space to the people who were insecure about their identity.\nToday, the State\u2019s desire for self-governance, as envisioned in the Article, is\npersistent. The earlier hope for people to acquiesce to the integration is\nfairly low. <\/li>\n\n\n\n<li>Experts said that\nthe real estate activity has been very limited in the J&amp;K region since the\nstate has always been in a vulnerable situation due to conflicts between India\nand Pakistan.<\/li>\n\n\n\n<li>The way permanent\nresidents are defined in the state of J&amp;K seems biased against women\n(Article 35A). <\/li>\n\n\n\n<li>Further, there is\na growing debate if Article 370 has only strengthened the separatist\ntendencies. Thereby, it has become essential to repeal the Article in a manner\nlaid out by the Constitution.<\/li>\n<\/ul>\n\n\n\n<p><strong>Is this an amendment to the\nConstitution?<\/strong><\/p>\n\n\n\n<ul>\n<li>Revoking Article\n370 would have required a constitutional amendment and also approved by the\nstate legislature. The government, instead, used powers granted under Article\n370 (3) to make special status inoperative. <\/li>\n\n\n\n<li>Under Article 370\n(3), the <strong>President can declare that Article 370 ceases to be operative or\noperates with exceptions and modifications.<\/strong> However, this can be done\nby the President only on the recommendation of the Constituent Assembly of the\nstate. Repealing of the article could be a legal uphill task for the center\nsince the constituent Assembly of the state ceased to exist in 1957. However,\nthe state legislative Assembly shares the same constituent powers, any changes\nto Article 35A can be done by it.<\/li>\n<\/ul>\n\n\n\n<p><strong>Why has the proposal been introduced\nin the Rajya Sabha?<\/strong><\/p>\n\n\n\n<ul>\n<li>The Rajya Sabha\nis an institutional mechanism to provide <strong>representation to the states<\/strong>.\nIts purpose is to protect the powers of the States. Therefore, any matter that\naffects the states must be referred to it for its consent and approval. Thus,\nif the Union Parliament wishes to remove a matter from the State list (over\nwhich only the State Legislature can make law) to either the Union List or\nConcurrent List in the interest of the nation, <strong>the approval of the Rajya\nSabha is necessary.<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>The outcomes if Article 370 ceases to\noperate: <\/strong><\/p>\n\n\n\n<ul>\n<li>With the abrogation of Article 370, the special autonomous status of J&amp;K will be gone. Consequently Article 35A, which originates from Article 370, will also cease to operate. People from any part of the country will be able to buy property and settle permanently in the state.
