{"id":2000,"date":"2019-08-01T12:57:02","date_gmt":"2019-08-01T07:27:02","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=2000"},"modified":"2024-06-07T17:19:24","modified_gmt":"2024-06-07T11:49:24","slug":"sc-judges-strength-increased-to-address-pending-cases","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/sc-judges-strength-increased-to-address-pending-cases\/","title":{"rendered":"SC Judges Strength Increased to Address Pending Cases"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News<\/h3>\n\n\n\n<p>The Cabinet gave its nod to increase the strength of the Judges\nin the Supreme Court by 10%. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail <\/h3>\n\n\n\n<ul>\n<li>The Chief Justice of India had requested the\nGovernment to increase the number of Judges in the SC over a month ago. <\/li>\n\n\n\n<li>Acting on the request, the union cabinet decided\nto increase the strength fro the current 31 to 34. <\/li>\n\n\n\n<li>A Bill in this regard will be placed in the\nongoing Parliament session. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Why the Need? <\/h3>\n\n\n\n<ul>\n<li>The Supreme Court is facing a large backlog of\npending cases which currently stands at 60,000 cases. <\/li>\n\n\n\n<li>The existing 30 Judges excluding the CJI are\nfinding it an uphill task to clear the cases. <\/li>\n\n\n\n<li>In 1988, the judges\u2019 strength was increased to\n26 from 18 and later in 2009, it was further increased to 31. <\/li>\n\n\n\n<li>More judges are needed to keep up with the\nincreasing number of cases and efficient working of the Supreme Court. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Pending Cases in High Courts <\/h3>\n\n\n\n<ul>\n<li>Across the country, there are 24 High Courts and\nthe pending cases have increased by 375,402 or 9.7% from 2015 to 2019. <\/li>\n\n\n\n<li>This despite sanctioning more judges in many\nhigh courts. <\/li>\n\n\n\n<li>In 2014, the sanctioned strength of judges for\nthe High Courts were 904 which was increased to 1079 by the end of 2018. <\/li>\n\n\n\n<li>The reason behind the increased pendency of\ncases was due to the current working strength of the Judges. In 2018, 679\njudges were working while 37% of the sanctioned strength falling vacant. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">What About Subordinate Courts?<\/h3>\n\n\n\n<ul>\n<li>As per the National Judicial Data Grid, there are 3.03 crore civil and criminal\ncases pending in the subordinate courts across the country.<\/li>\n\n\n\n<li>Here too the sanctioned strength has been\nincreased from 19,518 to 22,833 till the end of 2018. yet, the pendency of\ncases has increased due to the vacant posts. While the working strength of\nsubordinate court judges has increased from 15,115 to 17,701, there is still a\nshortage of 5,132 judges. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Alternative Avenues <\/h3>\n\n\n\n<ul>\n<li>To dispose off the pending cases, the Department\nof Justice has launched the <strong>Nyaya Mitra Scheme <\/strong>in 2017, where retired\njudicial officers and retired government officers with a legal background are\nappointed as Nyaya Mitras. <\/li>\n\n\n\n<li>They assist the court they are assigned to in\nreducing the pending cases and speed up the process of justice delivery. <\/li>\n\n\n\n<li>They will handle cases that are more than 10\nyears old. <\/li>\n\n\n\n<li>Another avenue for disposing of cases is the <strong>Lok\nAdalats<\/strong>. This alternative dispute redressal mechanism will settle cases\nthat are pending in the court of law or in the pre-litigation stage amicably. <\/li>\n\n\n\n<li><strong>Mediation<\/strong> is another alternative\nmechanism through which pending cases are being settled out of Court. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion <\/h3>\n\n\n\n<p> SC and HCs have to do much more to reduce the number of pending cases in the country.
