{"id":1997,"date":"2019-07-31T10:36:16","date_gmt":"2019-07-31T05:06:16","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=1997"},"modified":"2024-06-06T15:14:37","modified_gmt":"2024-06-06T09:44:37","slug":"consumer-protection-bill-passed","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/consumer-protection-bill-passed\/","title":{"rendered":"Consumer Protection Bill Passed"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">In News<\/h2>\n\n\n\n<p>The Lok Sabha has passed the Consumer Protection Bill 2018 that\nwill strengthen the rights of the consumers. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail <\/h3>\n\n\n\n<ul>\n<li>The Bill along with strengthening consumer\nrights provides a mechanism to address the grievances of the consumers\nregarding defects in goods and deficiency in services. <\/li>\n\n\n\n<li>Appropriate authorities will be set up for\ntimely and effective administration and settlement of disputes. <\/li>\n\n\n\n<li>The Bill replaces the Consumer Protection Act,\n1986. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Consumer Disputes Redressal\nCommission&nbsp;<\/h3>\n\n\n\n<ul>\n<li>The Bill proposes to set up a Consumer Disputes Redressal Commission, and\ndistrict, state and national level forums to adjudicate consumer complaints. <\/li>\n\n\n\n<li>A Central Consumer Protection Authority (CCPA)\nwill be set up to promote, protect and enforce consumer rights. <\/li>\n\n\n\n<li>The CCPA will prevent consumer detriment arising\nfrom unfair trade practices. It also has the power to initiate class action,\nand recall, refund and return products. <\/li>\n\n\n\n<li>There is no such authority now to act against\nunfair trade practices. The CCPA will change that. <\/li>\n\n\n\n<li>The CCPA will act immediately on any complaints\nfiled by the consumer. <\/li>\n\n\n\n<li>The Bill also proposes action against misleading\nadvertisements. Action will be against the adviser and not on the media through\nwhich the ad is published. <\/li>\n\n\n\n<li>If any harm is done to the consumers on account\nof deficient services or faulty products, there will be product liability\naction.<\/li>\n\n\n\n<li>There is also a provision for post-litigation\nstage mediation. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Penalties On Celebrities <\/h3>\n\n\n\n<ul>\n<li>The bill has provisions to penalise celebrities\non misleading advertisements.<\/li>\n\n\n\n<li>For the first offence, a one-year ban on\nendorsements and Rs. 10 lakh fine. <\/li>\n\n\n\n<li>For the second offence, Rs. 50 lakh fine and a\nthree-year ban on endorsements. <\/li>\n\n\n\n<li>For manufacturers and services providers, the\nfine for the first offence is Rs. 10 lakhs and a jail;-term of up to two years.\n<\/li>\n\n\n\n<li>For any subsequent offences, Rs. 50 lakh fine\nand a jail term of 5 years.<\/li>\n\n\n\n<li>In case of adulteration, the Bill proposes a\nlifetime of jail. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Some Questions <\/h3>\n\n\n\n<ul>\n<li>While discussing the Bill, the members of the\nopposition raised some questions over the bill.<\/li>\n\n\n\n<li>There was a question on different testing\nparameters in different states and the Bill is not addressing that issue. For\nexample, in the case of an instant noodles brand, different state government\nlabs gave different test reports. While some banned the product, the others\ncontinued its sale. <\/li>\n\n\n\n<li>Questions were raised over surrogate advertising\nfor which there is no provision in the bill. <\/li>\n\n\n\n<li>A question was raised over how the district\nconsumer forums will be formed and how will they dispose the existing cases. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion <\/h3>\n\n\n\n<p>Questions apart, the Consumer Protection Bill, 2019 will definitely protect the rights of the consumers. It will make the manufacturers and service providers desist from providing defective goods and services. The dispute redressal mechanism is also in favour of the consumers. The highlight of the Bill is the CCPA.
