{"id":1959,"date":"2019-07-20T14:29:04","date_gmt":"2019-07-20T08:59:04","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=1959"},"modified":"2019-07-20T14:29:06","modified_gmt":"2019-07-20T08:59:06","slug":"lok-sabha-passes-nhrc-amendment-bill","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/lok-sabha-passes-nhrc-amendment-bill\/","title":{"rendered":"Lok Sabha Passes NHRC Amendment Bill"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News <\/h3>\n\n\n\n<p>The Lok Sabha has passed a Amendment bill that amends the Protection of Human Rights Act, 1993 changing many provisions for the constitution of the National Human Rights Commission (NHRC).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail<\/h3>\n\n\n\n<ul><li>The Protection of Human Rights (Amendment) Bill,\n2019 has many provisions on the way the NHRC is constituted. <\/li><li>The Bill provides:<\/li><\/ul>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 1. A former\nSupreme Court Judge is now eligible to be appointed as Chairperson of the\nCommission. Earlier, only a former Chief Justice of India is appointed as the\nchairperson.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2. The total\nnumber of members have been increased to three from two, of which one shall be\na woman. These members should have a knowledge on human rights.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 3. The\nchairpersons of the National Commission for Protection of Child Rights,\nNational Commission for Backward Classes and the Chief Commissioner for Persons\nwith Disabilities are now deemed as members of the Commission <\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 4. The term of\nthe members of the Commission, both in state and at centre, has been reduced to\nthree years from five years and are eligible for re-appointment.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 5. For the state\nCommissions, a person who has served as a High Court Judge is also now eligible\nfor appointment as the Chairperson. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Opposition To The Bill&nbsp; <\/h3>\n\n\n\n<ul><li>The members of the opposition claimed that the\nBill in its current form does not address many human rights that the country is\nfacing. <\/li><li>They have claimed that reduction in the tenure\nof the Commissioner will lead to inconsistency in the working of the commission.\n<\/li><li>Also, the Bill is not in adherence with the\nParis Principles that sets international standards in setting up of human\nrights institutions. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Human Rights <\/h2>\n\n\n\n<p>Human rights is an important issue world over ever since the\natrocities committed in the World War II. The declaration of human rights by\nthe United Nations has laid the foundation for a moral living by the humans.\nThese rights are universal in nature.<\/p>\n\n\n\n<p>Members of the UN adopted these rights into their legal\nframework. It provides a dignity of life to every human being.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion<\/h3>\n\n\n\n<p>As the opposition claims, there are many gaps in the Bill. The reappointment clause is such an example. It might lead to members and Chairperson toeing the line of the government. It affects the autonomy of the Commission.
