{"id":1950,"date":"2019-07-18T12:24:17","date_gmt":"2019-07-18T06:54:17","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=1950"},"modified":"2024-06-07T17:58:35","modified_gmt":"2024-06-07T12:28:35","slug":"motor-vehicles-amendment-bill-tabled-in-the-parliament","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/motor-vehicles-amendment-bill-tabled-in-the-parliament\/","title":{"rendered":"Motor Vehicles (Amendment) Bill Tabled In The Parliament"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News <\/h3>\n\n\n\n<p>Motor Vehicles Bill was tabled and passed by the Lok Sabha but lapsed due to non-passage by the Rajya Sabha in 2018 is again tabled in the Parliament for its approval. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail <\/h3>\n\n\n\n<ul>\n<li>The <a href=\"https:\/\/auto.ndtv.com\/news\/union-minister-nitin-gadkari-tables-motor-vehicles-amendment-bill-in-parliament-2069879\">Motor Vehicles<\/a> (Amendment) Bill, 2019 was tabled in the Lok Sabha by the Ministry of Road Transport. <\/li>\n\n\n\n<li>If passes, the will amend the Motor Vehicles Act, 1988.<\/li>\n\n\n\n<li>The new Bill has many proposals ranging from compensation to the accident victims to third party insurance.<\/li>\n\n\n\n<li>It aims to make our roads safer and secure. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">The Proposals <\/h3>\n\n\n\n<ul>\n<li>The bill proposes hefty fines for traffic\nviolations.\n<ul>\n<li>Rs. 1,000 fine for not wearing seatbelt or\nhelmet. <\/li>\n\n\n\n<li>Over-speeding will attract Rs. 5000 fine.\nCurrently, it is Rs. 500.<\/li>\n\n\n\n<li>Drunken driving will attract Rs. 10000 fine. <\/li>\n\n\n\n<li>Some new provisions include Rs. 10000 fine for\nnot giving way for emergency services. <\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Issuing driving licences will be changed with\nthe new Bill. It makes Aadhar mandatory for applying for driving licence and\nvehicle registration. The validity of the licence will be brought down to 10\nyears from the current 20 years. Also, people above the age of 55 years\napplying for DL, it will be eligible for 5 years. <\/li>\n\n\n\n<li>The Bill recognises cab aggregators like Ola and\nUber. It defines them as a digital intermediary or market place. State\ngovernments are entitled to give licences to such aggregators based on the\nguidelines framed by the Union government. Aggregators are also mandated to\nadhere to the provisions of the Information Technology Act, 2000.<\/li>\n\n\n\n<li>As per the new Bill, the Central government can\nrecall vehicles under certain circumstances. Also, the manufacturer of the car\nwill be asked to either pay the full cost of the car or replace it. <\/li>\n\n\n\n<li>In case of a motor accident, the third-party\nliability will now be Rs. 10 lakhs in case of death and Rs. 5 lakh in case of\ngrievous injury. The insurance companies are allowed to pay only up to this\namount. But, the Bill allows paying any amount set by the Courts as\ncompensation. The government will set the minimum premium to be paid. <\/li>\n\n\n\n<li>In case of a juvenile with no learner\u2019s licence\ncauses an accident, the liability will be on the guardian or the parent. They\nare punishable with imprisonment which may be extended to three years along\nwith a fine of Rs. 25000. <\/li>\n\n\n\n<li>The bill also proposes to develop a National\nTransportation Policy on the transportation of goods and passengers in the\ncountry. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Opposition <\/h3>\n\n\n\n<ul>\n<li>Members of the opposition allege that the Bill\ntakes away the decision making powers of the states. <\/li>\n\n\n\n<li>To counter this, the union government has stated\nthat the states have flexibility in implementing the act and it does not take\naway their rights. <\/li>\n<\/ul>\n\n\n\n<p>Conclusion  In our country, 5 lakh people are injured in road accidents every year. The Ministry of Road Transport has made road safety its utmost priority. The Bill when becomes as Act will rectify the shortcomings in the present Act and make our roads safer. <\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<div
