{"id":1923,"date":"2019-07-12T14:05:42","date_gmt":"2019-07-12T08:35:42","guid":{"rendered":"https:\/\/www.classiciasacademy.com\/blog\/?p=1923"},"modified":"2024-06-07T16:57:26","modified_gmt":"2024-06-07T11:27:26","slug":"strengthening-pocso-act","status":"publish","type":"post","link":"https:\/\/www.classiciasacademy.com\/blog\/strengthening-pocso-act\/","title":{"rendered":"Strengthening POCSO Act"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">In News <\/h3>\n\n\n\n<p>The Union Cabinet has given its approval to amendments to the <strong>Protection of Children From Sexual Offences Act (POCSO Act) <\/strong>which gave a new definition to child pornography. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In-Detail <\/h3>\n\n\n\n<ul>\n<li>So far, there is no clear definition of Child Pornography in Indian laws. <\/li>\n\n\n\n<li>Section 67 of the IT Act and Section 293 of the IPC defines it clearly allowing the offenders to scot-free.<\/li>\n\n\n\n<li>In such a scenario, the proposed amendments to the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Child_sexual_abuse_laws_in_India\">POCSO<\/a> Act clearly defines what entails child pornography. <\/li>\n\n\n\n<li>The new definition says, <strong>\u201cAny visual depiction of sexually explicit conduct involving a child which include photographs, video, digital or computer-generated image indistinguishable from an actual child and an image created, adapted or modified but appear to depict a child.\u201d<\/strong><\/li>\n\n\n\n<li>In essence, the amendment will make people watching, possessing, spreading\/sharing content depicting sexual acts on underage children a punishable offense that could lead to a jail term. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">POCSO Act <\/h3>\n\n\n\n<ul>\n<li>The Act was enacted in 2012.<\/li>\n\n\n\n<li>It is to protect children from sexual assault. <\/li>\n\n\n\n<li>It is a gender-neutral act. <\/li>\n\n\n\n<li>As per the act, any person below the age of 18\nis considered as a child. <\/li>\n\n\n\n<li>It has many stringent provisions. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">The Amendments<\/h3>\n\n\n\n<ul>\n<li>Ministry of Women and Child Development has\nproposed the amendments to the Act.<\/li>\n\n\n\n<li>As per the proposals, the fine for possessing\nand not deleting child porn is Rs. 5000\/-. If the intention of such a holder is\nto spread rather than reporting it then the punishment is up to three years in\njail. <\/li>\n\n\n\n<li>It is also an offense under the new definition,\nof adults pretending as children and holding sexually explicit content where\ndigitally morphed images are used.<\/li>\n\n\n\n<li>This addresses the issue of cyberbullying of\nchildren by using morphed images. <\/li>\n\n\n\n<li>The amendments also include the death penalty in\ncases where aggravated assault is involved.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion<\/h3>\n\n\n\n<p>Child pornography has become a major problem in India. Much of\nsuch content which are clearly pornographic in nature has withstood scrutiny\nfor the want of proper definition. The new definition proposed by the WCD\nMinistry gives clarity on what entails child pornography. <\/p>\n\n\n\n<p>The proposed amendments to the POCSO Act also acts as a strong\ndeterrent against child sexual offences. They will strengthen the Act and give\nmore teeth to the law enforcement agencies to act against such offenders.<\/p>\n\n\n\n<p>Already the government has signed an MoU with the US to tackle the issue of child pornography where the US\u2019s National Centre for Missing and Exploited Children (NCMEC)&nbsp;will share tipline reports on child pornography and child exploitation content with India\u2019s National Crime Records Bureau (NCRB). The reports along with the proposed amendments will help the law enforcement agencies to act fast and bring the culprits to book.
